Beginning April 1st, 2023, major changes to trash rules are now in effect in NYC. These changes affect everybody – stores, commercial property owners, and residents alike. Please note there is only a short warning period. On May 1st, you will be expected to be fully compliant or you will receive fines. Initially there was no cure period at all, but thanks to the the advocacy of the NYC BID Association, including the NoHo BID, we have secured a one month warning period. We’ve broken down what the rules mean for you below. Please reach out to us with any questions you have.
For Storefront Businesses and Commercial Property Owners:
Under the new rules, businesses are only allowed to set their trash out in bags if you do so at 8:00 PM or later. If you close before 8:00 PM, you can place your trash out an hour before closing, but you must put the garbage out in a secure container, like a trash bin with a lid. Any trash container with a lid seems to be allowed, at present. Bundled cardboard can be places next to the cans. Trash should be placed on the curb.
This new rule will apply to all stores, regardless of size. You may use multiple bins if necessary. Please make sure to begin asking your private carter about this now. Bins must be stored in your business during opening hours. If you have a loading dock, these rules do not apply to you.
We understand this is a major change for businesses. We recommend buying containers/garbage bins with lids right away, as supplies will likely be limited in the days leading up to the rule change.
For Residents:
Residential buildings will also see changes to how they set out trash. The rules for trash will be changed from the current 4:00 PM setout time to the below options:
- Place trash out after 6:00 PM in a secure container
- Place trash out after 8:00 PM if putting bags directly on the curb
- If a building has nine or more residential units, the property owner may opt in to a 4:00 – 7:00 AM set-out window instead. The opt-in period will run for the month of January each year, allowing DSNY to design quick and efficient routes that take effect April 1st, 2023.
